Appeal Courts Declares Senator Adeleke's Eligibility For Osun State Governorship Election


On Saturday 6th of April 2019, thr Akure Appeal Court has declared the eligibility of Osun State governorship candidate of PDP Ademola Adeleke , in the last Osun governorship election, to contest the election.

The judgment followed  an earlier judgement of a high court in Bwari Abuja which declared him ineligible to contest the election. The issue points on the controversy over Adeleke's secondary School certificate submitted to INEC for the election is invalid , so failed to satisfy the minimum requirement for eligibility to contest the election.

The Appeal Court with three member panel  of M.A. Danjuma (presiding) R.M. Abdullahi , and P.A. Mahmoud, allowed the appeal and revoked the judgement of the High Court in Abuja. The Court also agreed with  the appellants that the matter was status bared given the limitation of time of 14-days within which a litigant on pre-election matters could institute a case.

Adeleke's guidance had raised these arguments before the Bwari High Court , which was ruled against him. He said the Abuja High Court had contradicted the Osogbo High Court verdict by rejecting the testimony of WAEC , which in a  sworn affidavit confirmed that Adeleke sat for it's examination and also attached the result to the affidavit.
